By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • Platform: The website, mobile application, and related services operated by GorgeousGuitars.com.
  • Vendor: Any individual or entity listing, marketing, or selling products or services on the Platform.
  • Customer/User: Any person browsing, purchasing, or interacting with listings on the Platform.
  • Products: Goods and/or services offered by Vendors through the Platform.
  • Account: A registered user profile required to access certain features.

2. Eligibility

To use the Platform:

  • You must be at least 18 years old (or the age of legal majority in your jurisdiction).
  • You must have the legal capacity to enter into binding contracts.
  • You must provide accurate and complete registration information.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Account Registration and Security

  • Users must create an account to purchase, sell Products, or interact with Vendors or Customers on the Platform.
  • You must have and maintain an active PayPal account to make a purchase via the Platform
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We are not liable for losses caused by unauthorized account use.

4. Role of the Marketplace

  • The Platform acts solely as an intermediary between Vendors and Customers.
  • We do not manufacture, store, inspect, or guarantee any Products listed.
  • Contracts for sale are formed directly between Vendor and Customer.
  • We are not responsible for Product quality, safety, legality, or accuracy of listings.

5. Vendor Terms

Vendors agree to:

  1. Provide accurate and lawful product listings.
  2. Comply with all applicable laws and regulations.
  3. Fulfill orders promptly.
  4. Honor refund and return policies stated in listings.
  5. Maintain required licenses and permits.
  6. Not list prohibited or illegal items.

We reserve the right to:

  • Remove listings.
  • Suspend or terminate Vendor accounts.
  • Withhold payouts in case of disputes, fraud, or violations.

6. Orders and Payments

  • All prices are listed in US Dollars
  • Payment processing is handled through third-party payment providers.
  • The Platform may collect commission or service fees.
  • Vendors are responsible for taxes, unless otherwise required by law.
  • Orders are subject to Vendor acceptance.

We are not responsible for payment processing errors caused by third-party providers.

7. Shipping and Delivery

  • Vendors are responsible for shipping and delivery timelines.
  • Shipping costs and delivery estimates must be clearly stated.
  • Risk of loss transfers according to applicable law or Vendor policy.

The Platform is not responsible for delays caused by carriers or customs.

8. Returns, Refunds, and Disputes

  • Return and refund policies are determined by each Vendor.
  • Customers must review Vendor policies before purchase.
  • We may facilitate dispute resolution but are not obligated to do so.
  • We reserve the right to make final determinations in disputes when necessary.

9. Prohibited Conduct

Engaging in Prohibited Conduct will result in permanent removal of your account from the Platform.

Users may not:

  • Use the Platform for illegal activities.
  • Post false, misleading, or defamatory content.
  • Interfere with Platform functionality.
  • Attempt unauthorized access to accounts or systems.
  • Circumvent fees or payment processes.
  • Engage in fraudulent transactions.

10. Intellectual Property

  • The Platform and its content (excluding Vendor content) are owned byGorgeousGuitars.com.
  • Vendors grant the Platform a non-exclusive, worldwide license to use, display, and promote listings.
  • Users may not copy, reproduce, or distribute Platform content without permission.

11. User-Generated Content

Users may submit reviews or content. By doing so, you:

  • Grant us a royalty-free, worldwide license to use and display such content.
  • Represent that the content does not violate any rights.
  • Agree not to post unlawful or harmful content.

We reserve the right to remove content at our discretion.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use personal data.

13. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of listings

We do not guarantee uninterrupted or error-free service.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages.
  • We are not responsible for Vendor actions or Product defects.

15. Indemnification

You agree to indemnify and hold harmless the Platform, its officers, directors, and employees from any claims, losses, damages, liabilities, and expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Platform
  • Your violation of any law or third-party rights

16. Termination

We may suspend or terminate your account at any time for:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Risk or harm to other users or the Platform

Termination does not affect accrued rights or obligations.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of New York State, United States.

Disputes shall be resolved through:

  • Negotiation
  • Mediation or arbitration (if applicable)
  • Courts located in Rockland County, NY

18. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted on the Platform with a revised “Last Updated” date.

Continued use of the Platform after changes constitutes acceptance.

19. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, government actions, strikes, or technical failures.
